O&G – REFINERY – BRAZIL – DISPUTE RESOLUTION RELATED SERVICES
Felipe was a party appointed Quantum Expert on many arbitration disputes to settle differences related to EOT impacts and cost overrun related to the construction of a 210mba Brazilian refinery. Amounts disputed were, in average per proceeding, over BRL 250 million. One example includes the Quantum expert appointment by the owner against a Brazilian contractor on the coke plant contract. Matters disputed were presented in an expert report and in an arbitral tribunal. Cross examinations took place from the other party’s counsel and the tribunal itself. The Experts had the opportunity to debate their technical viewpoints through a hot tubbing section. Testimony was made in Sao Paulo (Brazil), in Portuguese, under the CAM-CCBC rules. Under the same refinery project, Felipe was a party appointed Quantum expert on many other disputes resolved under the same venue, law, seat and language.
CONTRACT ADMINISTRATION – ESMERALDAS REFINERY REVAMP PROJECT
Services included Contract Administration related support for the management and inspection team hired for the Rehabilitation Project of the Esmeraldas State Refinery, formed by Ecuadorian contractors and subcontractors, being EP Petroecuador the hiring company (owner).
O&G – USA – GAS COMPRESSION STATION – DISPUTE RESOLUTION RELATED SERVICES
Service included appointment as party Quantum Expert to testify on costs overrun disputes/claims resolved through the Texas court. Amounts disputed were in excess of $ 20 million. Parties involved an USA general contractor, Transcontinental Gas Pipeline Company (operator) and Williams (owner). The project involved the rehabilitation of a compressor station that had an explosion accident and additional improvement and capacity improvement of the plant. The case settled after a few mediation meetings.
O&G – MEXICO – OIL PLATFORM EPC PROCESS
Project in Mexico which included the installation and commissioning offshore oil platform. This project involved a complaint about delays and costs during the execution of the project.
O&G – REFINERY – MEXICO – CDR
Services included the preparation, presentation and negotiation of delay and cost overruns claims on behalf of contractor on a USD 600 million project.
O&G – DISTRIBUTION – PERU – INTERNATIONAL ARBITRATION RELATED TO 2 GAS TREATMENT AND DISTRIBUTION PLANTS IN THE PERUVIAN JUNGLE.
Working for an Argentinian contractor (owned by a Spanish contractor group), current members of CONEXIG led the technical team of the contractor on an important arbitration case against a massive European O&G owner/operator. This international arbitration took place with seat in Peru, under Peruvian law at the Chamber of Commerce of Lima Arbitration Center and was conducted in Spanish. Services included Expert Witness services with testifying expert’s cross examination taking place in Lima. Disputed matters included standard of care (project and contract management practices), additional time and associated costs as well as additional direct costs. Contractor was awarded all claimed amounts as well as a reimbursement of the proceeding costs.
O&G – Colombia - Contractual forensic audit - GRFC
Our 8-month work spanned several phases, such as preparing a list of possible types of fraud and corruption that could have occurred, preparing a sample study of various contracts that needed to be reviewed, for which fraud indicators were applied quantitative and qualitative and the performance of business intelligence activities in relation to the suppliers of interest. This work allowed the company to address several weak aspects of its integrity program.
