RELEVANT PROJECTS IN EN PERU

International arbitration related to 2 gas treatment and distribution plants in the Peruvian jungle.
Working for an Argentinian contractor (owned by a Spanish contractor group), current members of CONEXIG led the technical team of the contractor on an important arbitration case against a massive European O&G owner/operator. This international arbitration took place with seat in Peru, under Peruvian law at the Chamber of Commerce of Lima Arbitration Center and was conducted in Spanish. Serivces included Expert Witness services with testifying experts cross examination taking place in Lima. Disputed matters included standard of care (project and contract management practices), additional time and associated costs as well as additional direct costs. Contractor was awarded all claimed amounts as well as a reimbursement of the proceeding costs.

Hydroelectric power plant: Dispute resolution related services
We ware part of an expert team assessing for the owner a USD100 million claim on the construction of a greenfield plant. As a result of our report, the contractor settled the case.

Instructed by attorneys from the CMS Grau office in Lima
The conclusions and professional fact based opinion of a Fraud Expert Investigation were presented in an expert report and in an arbitral tribunal hearing. Cross examinations took place from the other party’s counsel and the tribunal. Resport and testimony were provided in Spanish.

Transmission Line: Dispute resolution related services
This assessment was for the independent review of an extension of time and related additional costs claimed by the contractor. This transmission line was attached to a large ethanol greenfield plant.

Transmission line project claims assessment for mediation with potential subsequent international arbitration
Services included retention to evaluate Claims of aproximately USD 200MM presented by the contractor asking for EOT and associated indirect costs. An Expert Report was used to support successful negotiation which initially was heading towards arbitration.
